4.2. Photographs are provided for illustrative purposes. Actual product appearance, color, or packaging may vary slightly due to manufacturing differences, display settings, or packaging updates.
4.3. The Customer is responsible for reviewing product descriptions, dimensions, compatibility information, and intended use before placing an order.
4.4. The Seller reserves the right to correct typographical errors, inaccurate descriptions, and other mistakes in the Store. Such corrections will not affect an order already accepted unless otherwise permitted by applicable law.

5. PRICES, CURRENCY, AND TAXES
5.1. Prices displayed in the Store are in United States dollars (USD), unless expressly stated otherwise.
5.2. The applicable product price is the price displayed when the Customer places the Order, subject to correction of an obvious pricing error before the Order is accepted.
5.3. Shipping charges and any other charges collected by the Seller will be displayed during checkout before the Customer completes the purchase.
5.4. Sales tax, use tax, customs duties, import taxes, brokerage fees, or other governmental charges may apply depending on the destination and the applicable laws.

5.6. The Customer is responsible for providing accurate billing and delivery information and for complying with applicable import requirements. This provision does not transfer to the Customer any legal obligation that applicable law places on the Seller.
5.7. The Seller does not guarantee that the total cost of an imported Product will be limited to the product price and shipping charge displayed at checkout if additional charges are lawfully imposed by customs authorities or other relevant authorities.
6. PLACING AND ACCEPTING ORDERS
6.1. Orders may be placed through the Store by selecting Products, adding them to the shopping cart, providing the requested information, selecting a payment method, and completing checkout.
6.2. Before submitting an Order, the Customer should verify the Products selected, quantities, delivery address, email address, shipping method, and total amount payable.
6.3. An automated email confirming receipt of an Order does not necessarily constitute final acceptance of that Order.
6.4. The Seller will confirm acceptance of an Order by email or by another appropriate electronic method. The sales contract is formed when the Seller accepts the Order, subject to applicable law.
6.5. The Seller may decline or cancel an Order where there is a legitimate reason, including suspected fraud, an incorrect price caused by an obvious error, unavailable stock, an invalid delivery address, or an inability to complete delivery.
6.6. If payment has been collected for an Order that the Seller cancels and the Product has not been shipped, the Seller will issue the applicable refund promptly.
6.7. The Customer must ensure that the contact information provided during checkout is accurate and that order-related messages can be received.
7. PAYMENT
7.1. Available payment methods are those displayed in the Store during checkout.
7.2. Payment must be completed using an available payment method in accordance with the instructions provided during checkout.
7.3. Orders may be processed after the Seller receives confirmation of payment or otherwise verifies that payment has been authorized, as applicable to the selected payment method.
7.4. The Seller does not receive or store full payment-card details where payments are processed directly by an independent payment service provider. Payment processing is subject to the relevant provider's terms and privacy practices.
7.5. If payment is declined, reversed, or not completed, the Seller may suspend processing or cancel the Order, subject to applicable law.
8. SHIPPING AND DELIVERY
8.1. Products are generally shipped from Poland to the delivery address provided by the Customer.
8.2. Available shipping methods, shipping costs, and estimated delivery times are displayed in the Store or communicated to the Customer before the Order is completed.
8.3. Any stated delivery period is an estimate unless expressly identified as a guaranteed delivery date. Actual delivery may be affected by carrier operations, customs clearance, weather, public holidays, or other circumstances beyond the Seller's reasonable control.
8.4. The Seller will make reasonable efforts to dispatch Orders within the stated processing or shipping period. If no shipping period is stated, the Seller will comply with applicable shipping-time requirements.
8.5. If the Seller cannot ship an Order within the applicable promised period, the Seller will notify the Customer as required by law and provide the legally required options, which may include agreeing to a delay or cancelling the Order for a refund.
8.6. The Customer is responsible for providing a complete and accurate delivery address. Additional costs resulting from an incorrect address, refused delivery, or failure to collect a parcel may be charged to the Customer only to the extent permitted by applicable law.
8.7. Tracking information will be provided when available from the shipping carrier.
8.8. If a parcel is delayed, lost, or delivered in damaged condition, the Customer should contact the Seller at shop@idealchimney.com with the Order number and relevant details. The Seller will investigate the matter and provide any remedy required by applicable law.
8.9. Nothing in this section limits the Customer's statutory rights concerning non-delivery, delayed delivery, or loss of goods.
9. CUSTOMS AND IMPORT REQUIREMENTS
9.1. Products shipped from Poland to the United States may be subject to customs inspection, import requirements, duties, taxes, or other charges.
9.2. Unless expressly stated otherwise during checkout, charges imposed by U.S. customs authorities, carriers, or customs brokers are not included in the product price or shipping charge.
9.3. The Customer should check applicable import requirements and possible additional charges before placing an Order.
9.4. Customs clearance may delay delivery. The Seller cannot guarantee a particular customs processing time.
9.5. If a shipment is held, refused, or returned due to customs requirements or the Customer's failure to provide information or pay charges, the parties' rights and responsibilities will be determined in accordance with applicable law and the circumstances of the shipment.
9.6. The Seller will not exclude or limit any responsibility for customs declarations, documentation, or other obligations that applicable law places on the Seller.
10. ORDER CANCELLATIONS
10.1. A Customer who wishes to cancel an Order before shipment should contact shop@idealchimney.com as soon as possible and include the Order number.
10.2. The Seller will make reasonable efforts to stop an Order that has not yet been shipped. Cancellation cannot be guaranteed once the Order has entered the dispatch process.
10.3. If the Seller cancels an Order, or if the Customer is entitled to cancel under applicable law, the Seller will provide the appropriate refund.
10.4. This section does not restrict any statutory cancellation or withdrawal rights available to the Customer.
11. VOLUNTARY RETURNS AND REFUNDS
11.1. In addition to any rights required by applicable law, the Seller offers a voluntary return policy under which the Customer may request a return within 14 calendar days after delivery.
11.2. To request a return, the Customer must contact shop@idealchimney.com, provide the Order number, identify the Product to be returned, and await return instructions.
11.3. Unless otherwise required by law or agreed by the Seller, the Customer must return the Product to the return address supplied by the Seller and is responsible for the return shipping costs for a change-of-mind return.
11.4. Products should be returned securely packaged and, where reasonably possible, in their original condition and packaging. The Customer may inspect a Product to the extent reasonably necessary to establish its nature, characteristics, and functioning.
11.5. To the extent permitted by applicable law, the Customer may be responsible for diminished value resulting from handling beyond what is reasonably necessary to inspect the Product.
11.6. The Seller will provide a refund for an approved return in accordance with the applicable policy and law. Refunds will normally be made using the original payment method unless another method is agreed or required.
11.7. The Seller may request reasonable information or photographs to identify the returned Product or investigate a reported problem.
11.8. The voluntary return policy does not limit any mandatory right to return, cancel, obtain a refund, or receive another remedy under applicable law. If a mandatory legal right provides more favorable terms, that right will prevail.
12. DAMAGED, DEFECTIVE, OR INCORRECT PRODUCTS
12.1. If a Product arrives damaged, defective, incomplete, or different from the Product ordered, the Customer should contact shop@idealchimney.com and provide the Order number and a description of the problem.
12.2. Photographs or other reasonable supporting information may be requested to help investigate the issue.
12.3. The Seller will review the complaint and offer an appropriate remedy in accordance with applicable law. Depending on the circumstances, this may include replacement, repair, refund, or another legally required solution.
12.4. The Customer should retain the Product and its packaging until the Seller provides instructions, where reasonably possible.
12.5. Nothing in these Terms excludes or restricts any mandatory warranty, guarantee, or consumer remedy that applies to the transaction.
13. PRODUCT SAFETY AND PROPER USE
13.1. Products must be used only for their intended purpose and in accordance with the instructions, warnings, and safety information provided with the Product or in the Store.
13.2. Chimney-cleaning equipment may involve rotating tools, drills, rods, brushes, and other components that can cause injury if used incorrectly.
13.3. Before use, the Customer should inspect the equipment for visible damage, ensure that components are correctly assembled and compatible, and follow the instructions of the relevant tool and equipment manufacturers.
13.4. The Customer must use suitable protective equipment and follow applicable workplace, fire-safety, and equipment-safety requirements.
13.5. Products should not be used in a manner inconsistent with their intended purpose, stated specifications, or safety instructions.
13.6. The Seller is not responsible for damage or injury caused by misuse, improper installation, unauthorized modification, failure to follow safety instructions, or use of incompatible equipment, except to the extent that applicable law makes the Seller responsible.
13.7. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded or limited.
14. WARRANTIES AND LIMITATION OF LIABILITY
14.1. The Seller will comply with applicable legal obligations relating to product conformity, warranties, and consumer remedies.
14.2. Any manufacturer's warranty will apply according to its own terms where one is provided and legally applicable. A manufacturer's warranty does not replace mandatory rights the Customer may have against the Seller.
14.3. To the fullest extent permitted by applicable law, the Seller is not liable for indirect or consequential losses arising from the use of the Store or Products, including loss of business opportunities or profits, unless such liability cannot legally be excluded.
14.4. The Seller does not guarantee uninterrupted or error-free operation of the Store.
14.5. Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence where such limitation is prohibited, product liability that cannot legally be excluded, or any other liability that cannot lawfully be limited.
14.6. Where permitted by law, the Seller's liability will be limited to the extent reasonably attributable to the relevant breach or event. This limitation does not affect mandatory consumer rights or remedies.

16.1. Unless otherwise stated, content available in the Store, including text, photographs, graphics, logos, product descriptions, and page layouts, is owned by or lawfully used by the Seller or the relevant rights holder.
16.2. Content may not be copied, reproduced, distributed, modified, or used commercially without prior permission from the applicable rights holder, except where permitted by law.
16.3. Product names, trademarks, and logos belonging to third parties remain the property of their respective owners.
17. CUSTOMER REVIEWS AND SUBMISSIONS
17.1. If the Store permits product reviews or other submissions, the Customer must ensure that submitted content is truthful, lawful, and based on genuine experience where it is presented as a customer review.
17.2. The Customer must not submit unlawful, misleading, fraudulent, defamatory, threatening, or infringing content.
17.3. By submitting content, the Customer grants the Seller a non-exclusive, royalty-free right to display and reproduce that content in connection with the Store and the relevant Product, to the extent permitted by law.
17.4. The Seller may remove or decline to publish content that violates these Terms or applicable law. Reviews will not be manipulated or presented in a misleading manner.
18. PRIVACY AND PERSONAL INFORMATION
18.1. The Seller processes personal information in connection with receiving and fulfilling Orders, communicating with Customers, processing payments, arranging delivery, handling returns and complaints, complying with legal obligations, and protecting the Store against fraud.
18.2. Personal information will be handled in accordance with the Store's separate Privacy Policy, which explains what information is collected, how it is used, the circumstances in which it may be shared, and any applicable rights of individuals.
18.3. The Customer should review the Privacy Policy before placing an Order.
18.4. Payment providers, shipping companies, technical service providers, and other service providers may process information as necessary to perform their respective services, subject to applicable law.
19. THIRD-PARTY SERVICES AND LINKS
19.1. The Store may use or link to third-party services, including payment processors, shipping carriers, analytics services, or external websites.
19.2. Third-party services are generally governed by their own terms and privacy policies.
19.3. The Seller is not responsible for the content or operation of external websites that the Seller does not control, except to the extent required by applicable law.
20. FORCE MAJEURE
20.1. The Seller will not be responsible for a delay or failure caused by circumstances beyond the Seller's reasonable control, such as natural disasters, war, civil unrest, government restrictions, transport disruptions, customs delays, widespread technical failures, or interruptions affecting essential services.
20.2. The Seller will take reasonable steps to reduce the effects of such circumstances and inform affected Customers when appropriate.
20.3. This section does not remove any refund, cancellation, or other rights that applicable law grants to the Customer.
21. GOVERNING LAW AND DISPUTES
21.1. These Terms and transactions through the Store are subject to applicable law, taking into account any mandatory consumer-protection provisions that apply to the Customer and the transaction.
21.2. Nothing in these Terms is intended to deprive a Consumer of any mandatory protection available under the law that applies to that Consumer.
21.3. The parties should first attempt to resolve any dispute by contacting the Seller at shop@idealchimney.com and providing the Order number and details of the issue.
21.4. If an informal resolution is not possible, either party may pursue remedies available through the competent courts or other procedures permitted by applicable law.
21.5. Nothing in this section requires a Consumer to waive a statutory right to bring a claim in a court that has jurisdiction under applicable law.
22. CHANGES TO THESE TERMS
22.1. The Seller may update these Terms from time to time to reflect changes in the Store, business operations, or applicable law.
22.2. The current version will be published on the Store with its effective date.
22.3. Changes will not retroactively alter the terms of an accepted Order unless permitted by law or agreed by the parties.
23. SEVERABILITY
23.1. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law.
23.2. Any invalid or unenforceable provision will be interpreted or replaced, where legally possible, in a manner that most closely reflects its original purpose while complying with applicable law.
